1. The service
darkrm is operated by [LEGAL OPERATOR NAME], an individual trading as darkrm, with correspondence address [CORRESPONDENCE ADDRESS]. darkrm is a photographer workspace for preparing editable titles, captions and hashtags alongside a photograph. You can upload a photograph, add optional working context, choose writing controls and save drafts. darkrm does not publish to social networks or connect to social accounts in the current service.
These Terms apply when you use the darkrm website, account and workspace. By creating an account or using the service, you agree to them.
2. Accounts, age and access
You must be at least 18 years old to create or use a darkrm account. Current account access is provided through Google sign-in. You are responsible for activity carried out through your account and for keeping access to your Google account secure. Tell us at [SUPPORT EMAIL], or through the Contact page, if you believe your account has been used without permission.
You may request account deletion, access to your personal information or a copy of relevant account content by contacting [SUPPORT EMAIL]. We may need to verify account ownership before acting on a request. There is no self-service account-deletion or data-export tool in the current service.
We may suspend or end access where reasonably necessary to protect the service, other users or our legal obligations.
3. Your photographs and information
You keep ownership of the photographs, written context and other material that you provide, subject to rights you actually hold. You give darkrm a limited, non-exclusive permission to store, resize or otherwise process, transmit for requested generation, display back to you and otherwise use that material only as reasonably necessary to operate the service for you.
darkrm does not receive permission under these Terms to sell, publicly publish, advertise with or train its own models on your photographs or other uploaded material. You must have the right to upload and use all material you provide. Do not upload material that is unlawful, infringes another person's rights, is confidential without authority, or contains personal information you are not allowed to share.
When you delete a photograph in the workspace, the service deletes its database record and associated saved versions, and attempts to remove the stored image file from active application storage. Backup deletion is subject to the retention target described in the Privacy Policy.
4. Generated output
darkrm can prepare a title, caption and hashtags from your photograph, selected controls and the information you provide. The output is a starting point for you to review, edit and decide whether to use. You are responsible for checking that any output is accurate, appropriate, lawful and suitable for its intended audience before publishing or relying on it.
We do not guarantee that generated output is factual, complete, unique, available for copyright protection, non-infringing or suitable for a particular purpose. Do not use it as legal, professional, medical, financial or other regulated advice.
5. Acceptable use
You must not misuse darkrm, interfere with its operation, attempt to gain unauthorised access, upload malicious code, circumvent usage controls, use the service to create unlawful or harmful material, or use automated means to access it except where we have agreed otherwise in writing.
You must not use darkrm to violate privacy, intellectual property, publicity or other rights. You must not present generated output as verified fact where it has not been checked.
6. Access, allowances and changes
darkrm currently provides the access and usage allowances shown on the Pricing page. No paid checkout or paid subscription is active in the current implementation. If paid subscriptions are introduced, the applicable price, billing frequency, renewal, cancellation, refund and statutory-rights information will be shown before purchase.
darkrm is an evolving service. We may change, pause or discontinue features where reasonably necessary to improve security, maintain the service, comply with law or develop the product. We do not promise uninterrupted or error-free availability.
7. darkrm intellectual property
The darkrm name, brand assets, website design and service materials belong to darkrm or its licensors. These Terms do not give you permission to use them except as necessary to use the service lawfully.
8. Disclaimers and liability
The service is provided on an "as available" basis. To the extent permitted by law, we do not make warranties about availability, accuracy, reliability, suitability or security. Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to that, we are not liable for loss that is not reasonably foreseeable, loss caused by your failure to review output or use the service safely, or business losses where the law permits those limits. Your mandatory consumer rights are not affected.
9. Changes to these Terms
We may update these Terms as the service develops. The latest version will be published on this page with a new last-updated date. If a change materially affects how you use the service, appropriate notice should be considered before it takes effect.
10. Governing law and contact
These Terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, except that consumers may also benefit from mandatory rights and protections that apply in their country of residence.
